1. Acceptance of Terms
By accessing this website or engaging services provided by Fascination Garden LLC, you agree to be bound by these Terms & Conditions and all applicable laws of the State of Washington.
2. Landscaping Estimates & Promotional Discounts
All preliminary quotes and promotional offers—including the 20% discount on the first project—are subject to property verification and a written agreement signed by the client and Baldomero Hernandez. Quotes remain valid for 30 days from the date of issue unless specified otherwise.
3. Property Access & Underground Utilities
Clients must grant reasonable property access for personnel, vehicles, and equipment during scheduled service hours. For heavy excavation, paver base preparation, and retaining wall installations, Fascination Garden LLC coordinates with Call Before You Dig (811) to locate public utilities. Clients must notify us of any private, non-locatable lines (such as private landscape lighting or invisible dog fences).
4. Intellectual Property
All content on this website—including photography, logos, graphic design, text, and 3D visualizers—is the intellectual property of Fascination Garden LLC and protected by applicable copyright and trademark laws.
5. Limitation of Liability
Fascination Garden LLC is licensed, bonded, and insured in Washington State (#FASCIGL782K9). We take utmost care in protecting client grounds. In no event shall Fascination Garden LLC be liable for damages resulting from extreme weather events, severe freeze cycles, drought, or pre-existing underground structural faults outside our agreed scope of work.
6. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.
